Spirit Therapy LLC operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Spirit Therapy LLC is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced here, describe your rights and responsibilities when you visit, interact with, or purchase from our Services.

However, colors, packaging, and product appearance may vary slightly due to screen settings, device differences, lighting, handmade production, natural ingredient variation, and small-batch processing.

Because many of our products are handcrafted or made with natural ingredients, slight variations in color, texture, scent, weight, or appearance may occur. These variations are normal and do not necessarily indicate a product defect.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantity of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.

Please review the full ingredient list before using any product. Our products may contain natural oils, butters, waxes, essential oils, botanical ingredients, fragrance materials, and other ingredients that may not be suitable for everyone. If you have sensitive skin, allergies, are pregnant or nursing, or have a medical condition, consult a qualified healthcare professional before use.

For topical products, we recommend performing a patch test before full use. Discontinue use immediately if irritation, redness, rash, discomfort, or an adverse reaction occurs. Unless specifically stated otherwise, our products are for external use only and should not be ingested or used in the eyes or on broken or irritated skin.

Our products and content are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Information provided on the Services is for general informational and educational purposes only and should not be considered medical advice.

Section 3 - Orders

When you place an order, you are making an offer to purchase. Spirit Therapy LLC reserves the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as Spirit Therapy LLC may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email address, billing address, shipping address, and/or phone number provided at the time the order was placed.

Your purchases are subject to return or exchange only in accordance with our Refund Policy. Please review our Refund Policy before purchasing.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export unless we have agreed otherwise in writing.

Section 4 - Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be listed in your order confirmation email. Posted prices do not include taxes, shipping, handling, customs, duties, or import charges unless expressly stated.

Prices posted in our online store may differ from prices offered at in-person events, retail locations, wholesale accounts, consignment partners, or third-party marketplaces. Promotional offers may be governed by separate terms and conditions. If there is a conflict between the terms for a promotion and these Terms of Service, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You agree to promptly update your account and other information, including your email address, payment information, and shipping address, so we can complete your transactions and contact you as needed.

You represent and warrant that any payment information you provide is true, correct, complete, and authorized for your use; that charges incurred by you will be honored by your payment provider; and that you will pay all charges incurred at the posted prices, including shipping, handling, and applicable taxes.

Section 5 - Shipping and Delivery

Shipping and delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, incorrect shipping information, high-volume shipping periods, or events outside our control.

Once products are transferred to the shipping carrier, title and risk of loss may pass to you and/or the carrier to the extent permitted by law. However, if your package appears delayed, damaged, or lost, please contact us and we will do our best to help you resolve the issue with the carrier.

Spirit Therapy LLC is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Spirit Therapy LLC.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Spirit Therapy LLC, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Spirit Therapy LLC.

The information presented on or through the Services is made available for general informational purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.

To the fullest extent permitted by law, in no case shall Spirit Therapy LLC, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort, negligence, strict liability, or otherwise, arising from your use of the Services or any products purchased through the Services.

This limitation applies to any claim related in any way to your use of the Services or any product, including errors or omissions in content, or any loss or damage incurred as a result of the use of the Services, content, or products made available through the Services, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Spirit Therapy LLC, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, demands, or expenses, including reasonable attorneys’ fees, payable to any third party due to or arising out of your breach of these Terms of Service or the documents incorporated by reference; your violation of any law or the rights of a third party; or your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. To the fullest extent permitted by law, you and Spirit Therapy LLC consent to venue and personal jurisdiction in the state or federal courts located in Pennsylvania for disputes arising out of or relating to these Terms or the Services.
